Italian citizens who are parents of minor children are hereby informed that, as of 14 June 2023, it is no longer necessary to submit the consent of the other parent for the issuance of their own identity and travel documents (passport and CIE), pursuant to Decree-Law No. 69/2023.
Specifically, the amended Article 3-bis of Law No. 1185/1967 provides that, where there is a concrete and present risk that, as a result of moving abroad, a parent may evade their obligations towards their children, the other parent may request a prohibition on the issuance of the document. Such an application may be submitted to the competent judge at the Ordinary Court where the minor has their habitual residence or, if the minor resides abroad, at the Court within whose jurisdiction the municipality where the minor is registered with AIRE is located.
For the issuance of identity and travel documents (passport or CIE) to minor children, however, the requirement for the consent of both parents, or of the person exercising parental responsibility, remains in place.
An application for the issuance of a CIE to a minor, submitted to the Consular Office on the day of the appointment, requires the written consent of both parents (or of the person exercising parental responsibility).
Consent to the issuance of a CIE for a minor may be given in one of the following ways:
- In person at this Consulate General on the day of the appointment (please note that the person giving consent must bring a valid identity document, both the original and a simple photocopy);
- In person at any Italian Public Administration Office authorized to authenticate signatures, sufficiently in advance of the CIE appointment (e.g. a Police Headquarters [Questura] or other diplomatic-consular mission);
- Italian and EU citizens may provide their consent by completing and signing the appropriate form, which will be provided on the day of the appointment.
