Law No. 379 of 14 December 2000 provides for the recognition of Italian citizenship for persons born and residing in the territories of the former Austro-Hungarian Empire and their descendants who meet the necessary requirements.
The deadline for submitting applications under Law No. 379/2000 expired on 19 December 2010.
Law No. 124 of 8 March 2006 provides for the recognition of Italian citizenship for nationals who lost their citizenship as a result of residing between 1940 and 1947 in Istria, Rijeka (Fiume), and Dalmatia.
The recognition of Italian citizenship pursuant to special laws constitutes acquisition of citizenship by benefit of law. Therefore, a parent who has acquired citizenship in this manner cannot make the declaration of intent to acquire citizenship on behalf of a minor child provided for under Article 4, paragraph 1-bis, of Law No. 91/1992, because the parent whose citizenship has been recognized is not an Italian citizen by birth.
